General sales conditions

Sales are regulated by these general conditions which must be considered an integral and substantial part of the sales contract. Therefore, before sending an order, we invite our customers to carefully read the sales conditions indicated above and the information contained therein, as well as the privacy policy statement available in the special section of the site, and print or save them on another durable medium to which you have access.

Customers will be notified promptly of any amendments or new sales conditions, which will take effect from the moment they are published on the site and will only be applied to sales concluded following their publication.

Customers sending orders are considered to accept the sales conditions in force at that time.

 

Concluding the contract

Orders sent by customers via the Internet must be completed in full and contain the details needed in order to identify the customer and the products ordered. In addition, they must indicate the place of delivery. Failing this, the order will be considered void. Menù S.r.l. will send an order receipt confirmation to the customer via e-mail, referring to the applicable sales conditions.

 

Product characteristics and availability

In particular circumstances, the manufacturer Menù S.r.l. may not be able to guarantee the availability of all the products in its range. As a result, it cannot be considered liable for the temporary unavailability of one or more products. Without prejudice to the agreement hereunder (right to withdraw), customers sending orders are also considered to accept a possible partial delivery restricted to the products available from those ordered. They are also considered to forgo the right to request damage and/or compensation in these circumstances. Menù S.r.l. undertakes, by law, to inform the customer promptly should any of the products ordered not be available. Should this be the case, the customer will only have to pay the price corresponding to the quantity of products actually delivered. Any excess amounts paid will be reimbursed within 10 days of sending the goods.

 

Right to withdraw

The customer has the right to withdraw from the contract, with no penalties and without having to explain why, within 10 days of receiving the goods, according to principles of fairness and good faith. Withdrawal notices must be sent to Menù S.r.l. in writing. In the notice the customer must indicate the product or products they intend to exercise their right to withdraw on. On its own initiative and at its own expense, Menù S.r.l. will collect the product or products in question following the procedure and terms agreed with the customer beforehand, unless it decides not to collect them. The right to withdraw must be exercised by registered letter with advice of delivery sent to Menù S.r.l., Via Concordia no. 25 - 41032 Cavezzo (MO) or alternatively by sending an e-mail to the address ordini@cucinaantica.it. Menù S.r.l. will take care of reimbursing the amount paid within 10 days of the goods returning to the warehouse.

For any notifications, complaints or requests for information, you can contact us directly at the address: ordini@cucinaantica.it quoting the number shown in the order confirmation e-mail.

 

Delivery

Menù S.r.l. delivers directly to the address indicated by the customer upon ordering; therefore, the goods ordered travel completely at the risk of Menù S.r.l. Depending on the location of the goods' destination, deliveries can take place in a time span varying from 2 to 5 working days after the order is made for deliveries in Italy, or from 3 to 6 working days after the order for deliveries in Europe, unless any setbacks occur. For customers registered on the Internet, Menù S.r.l. provides an on-line tool for visualising the present status of orders under delivery.

 

Prices and payment methods

The prices of the products indicated in the various sections of this site are valid for both Italy and Europe and include VAT, containers and packaging. Any delivery costs will be indicated specifically upon confirmation of the order and before payment. The prices applied are the ones indicated on the site at the time the customer makes their order. The prices of the single products may vary and therefore the prices indicated on the site each time cancel and substitute those previously indicated. The price of the products purchased, together with the cost of home delivery, must be paid by the customer when making the order on-line by credit card (Visa, Visa Electron, Aura, MasterCard, American Express, Ricarica Paypal), or alternatively by bank draft. In the event of payment by bank draft, the order will be suspended until the payment has been received.

 

Guarantees and liabilities

Within the limits of availability as regulated above, the manufacturer Menù S.r.l. guarantee that it will deliver products that are the same as those indicated and described on the web site. Menù S.r.l. guarantees its full respect of all the standards regarding product preservation up to the moment of delivery in the place indicated in the order. The producer is liable for all the products sold. For packaged products, the producer is also liable for the truthfulness and completeness of the indications shown on the packaging. The images on the site are provided to the customer in order to make it easier to recognise the products; due to variations in the packaging made by the producer, the photos may not exactly reflect the appearance of the delivered product.

 

Disputes and applicable law

Civil disputes pertaining to the application, execution and interpretation of the long-distance sales contract fall under the jurisdiction of Italian law and the place of jurisdiction shall be the customer's place of residence or domicile, if located in Italy. Long-distance contracts drawn up with Menù S.r.l. are regulated by Italian law and legal regulations are valid for anything not expressly provided for herein.
